1.1 iSite Terms of Use

Before using the iSite database, each practitioner using the iSite service to access patient information (Practitioner) must agree to the following terms of use (iSite Terms of Use). ACT X-Ray Services takes the privacy of patient's personal information very seriously and requires all Practitioners who access and utilise this information to use the iSite database strictly in accordance with these terms of use.

1.2 Accessing personal information

Practitioner may only access an individual's personal information (including x-ray images and other patient records) stored on the iSite database if they are: (i) the practitioner who referred the patient to ACT X-Ray Services (Referring Practitioner); or (ii) a specialist practitioner who has been requested to access the information by the individual's Referring Practitioner in order to assist in the diagnosis or treatment of the patient (Specialist Practitioner). Practitioners are only permitted to access and use an individual's personal information for the purpose(s) for which it was collected and, in the case of Specialist Practitioners, only for the purpose(s) identified to them by the Referring Practitioner.

1.3 Storing personal information securely

Practitioner must ensure that all information accessed, reproduced or recorded from the iSite database is stored securely by Practitioner and that any personal information obtained through the database that is no longer required is maintained or destroyed in accordance with applicable privacy laws.

1.4 Passwords and security

Practitioner agrees to keep Practitioner's username and password confidential and to not disclose this information to any other party (except ACT X-Ray Services as necessary). Practitioner is responsible for use of the iSite database where such use occurs under Practitioner's access details (except where ACT X-Ray Services is responsible for such access). Practitioner must immediately notify ACT X-Ray Services if Practitioner becomes aware that any other party has obtained Practitioner's username and/or password, or has otherwise obtained unauthorised access to the iSite database.

1.5 Disclaimer

To the extent permitted by law, the iSite database and the materials stored on and made available via the iSite database are provided by ACT X-Ray Services free of any warranties or guarantees, express or implied. ACT X-Ray Services does not warrant that the iSite database will be error free, and each Practitioner, patient or other party who relies on the iSite database or materials obtained via the iSite database does so at that party's risk.

1.6 Indemnity

Practitioner agrees to indemnify, defend and hold harmless ACT X-Ray Services for any loss, damage or expense that ACT X-Ray Services incurs as a result of a breach of the iSite Terms of Use, or contravention of any applicable law, by Practitioner.

1.7 ACT X-Ray Services privacy policy

When using the iSite database or personal information stored on the iSite database, Practitioner must comply with the terms of ACT X-Ray Services' privacy policy. This policy is available at http://www.canberraimaging.com.au/privacy.htm

1.8 Applicable law

In using the iSite database, and information accessed via the database, Practitioner is required to comply with the Privacy Act 1988, the Health Records (Privacy and Access) Act 1997 and other applicable laws and regulations.

In these Terms of Use, ACT X-Ray Services means ACT X-Ray Services Pty Limited (ABN 93 245 601 531), its related entities, and their employees, agents, officers and personnel.
